DISPUTE: Involves the Company's refusal to expunge 25 demerit marks from Conductor J.V. Seberras' work record. JOINT STATEMENT OF ISSUE: Conductor J.V. Seberras received a CP form 108 assessing his work record with 25 demerit marks for:
The Union appealed this decision of the Company with argument that Mr. Seberras was in fact seeking permission for the oil and when advised to put it back he did. At no time was the oil used for Mr. Seberras' personal use. With letter dated February 28, 2005 the Company declined the Union's request.
